Mediation in Sexual Harassment Cases
Tim Hicks
Mediation can provide an ideal setting in which
the complainant can accomplish the primary aim
of stopping the behavior. Without such a mechanism
for dealing with the situation, the complainant has
only two choices: go through the process of a
formal complaint and investigation, or do nothing.
These options often do not meet the needs of the
employee or the organization.

The corporate culture of companies is increasingly
influenced by the Internet. In the virtual workplace
managers and employees operate remotely from
each other. Will the virtual workplace change the
corporate norms, communication styles, and
behavior of employees?

2. Supreme Court Decisions:
2.1. The Reach Of Disability Law In The Workplace
The Supreme Court limited the reach of a landmark
disability rights law with a unanimous decision that
an assembly line worker with carpal tunnel syndrome
was not entitled to special treatment on the job,
according to published reports. The Supreme Court
ruled that Ella Williams' partial disability did not
obligate her employer, car manufacturer Toyota,
to tailor a job to suit her wrist, arm and shoulder
problems.
2.2. EEOC Permitted To Sue On Worker's Behalf
Arbitration agreement does not bar EEOC's
suit for victim-specific remedies. When employees
have ceded the right to sue their employers, the
federal EEOC may step in to win back
pay or other help for workers, the Supreme Court
ruled this week. The 6-3 ruling gives employers'
less power to settle on-the-job disputes out of
court and clarifies the scope of the EEOC.

plenty of new thoughts on ADA mediation,

9. New Book
I Hear What You Say, But What Are You Telling Me?
The Strategic Use of Nonverbal Communication in
Mediation
Author: Barbara G. Madonik
This book is a fascinating, original, and invaluable
tool kit filled with practical information and techniques
for mediators who want to use nonverbal
communication to their strategic advantage.
Using a proven process the author reveals how to
understand, analyze, and utilize nonverbal
communication in resolving conflict. Mediators
are guided through seven steps. In these steps
mediators learn how to prepare themselves and
setup their working environments to increase their
effectiveness; maximize initial telephone contact;
manage the mediation environment so they can
control it; assess and profile each person; engage
all parties to create powerful rapport and guide them
to communicate with each other; trigger action that
puts derailments back on track and builds momentum
toward resolution; bring closure to the parties and the
process. Peppered with fascinating stories and examples
drawn from real-life experience, this step-by-step guide
uncovers the hidden meaning of conscious and
other-than-conscious communication--body language,
breathing, dress, time, speech patterns, and much more.
With this knowledge, mediators have deeper
understanding and greater control of a wide variety of
conflicts, including employment, labor, commercial,
consumer, family, community, and government disputes.
